Terms of Use

The short version. Use SubCap on videos you have the right to use. Pro is an auto-renewing subscription billed by Apple; cancel any time in your App Store settings, at least 24 hours before renewal. Your videos remain yours. The app is provided as-is, and refunds are handled by Apple.

1. Agreement

These Terms of Use ("Terms") are a contract between you and SubCap, Surat, Gujarat, India ("we", "us") governing your use of the SubCap iOS application and any related services (the "App"). By downloading or using the App, you accept these Terms. If you do not accept them, do not use the App.

These Terms incorporate Apple's Standard End User License Agreement. Where that EULA and these Terms conflict on licensing matters, the more protective term for you applies.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent where you live) and legally able to enter into a contract. If you use the App on behalf of an organisation, you confirm you are authorised to bind it.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not:

You keep all rights to the videos, audio, and caption text you bring into the App ("Your Content"). We claim no ownership over it.

You grant us only the limited licence needed to run the service: to process Your Content on your device and to transmit the extracted audio to our transcription provider so captions can be produced for you. That licence ends when processing ends.

You are responsible for Your Content. By using the App you confirm that you own it or have the necessary rights and permissions, including from anyone whose voice or likeness appears in it, and that processing it does not violate any law or third-party right.

Prohibited content

Do not use the App to process content that is unlawful, that infringes someone else's intellectual property or privacy, that depicts child sexual abuse, or that is intended to harass, defraud, or create deceptive impersonations of real people.

5. Captions are machine-generated

Captions are produced by automated speech recognition. Accuracy varies with audio quality, accent, background noise, terminology, and language. Transcripts may contain errors, omissions, or mistimed text. Review captions before publishing. The App is not suitable as the sole means of producing legally required accessibility captions, medical or legal transcripts, or evidentiary records, and we make no warranty of accuracy or fitness for those purposes.

6. Subscriptions and payment

Refunds

Purchases are processed by Apple, so refunds are handled under Apple's policy — request one at reportaproblem.apple.com. We cannot issue refunds directly. Statutory withdrawal rights, where they apply to you, are unaffected.

Price changes

We may change subscription pricing. Apple will notify you and, where required, ask for your consent before a price increase takes effect. If you do not agree, cancel before the next renewal.

7. Free tier and watermark

Without an active Pro subscription, exported videos may carry a SubCap watermark and other limits may apply. Removing or obscuring the watermark by any means other than subscribing is a breach of these Terms.

8. Availability and changes

Caption generation depends on a network connection and on third-party services. We may modify, suspend, or discontinue any feature at any time, and we do not guarantee uninterrupted or error-free operation. If we discontinue a paid feature entirely, we will provide reasonable notice through the App or the App Store.

9. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or loss of the videos you process. Our total aggregate liability arising out of or relating to the App is limited to the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD 50.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Consumers retain all non-waivable statutory rights.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising from Your Content or from your breach of these Terms or of any law.

12. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your access if you materially breach these Terms or use the App unlawfully. Sections 4, 9, 10, 11, and 13 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts of Surat, Gujarat have exclusive jurisdiction. If you are a consumer, you retain the protection of the mandatory laws of your country of residence and may bring proceedings there.

14. Apple

Apple is not a party to these Terms and has no responsibility for the App or its content. Apple has no obligation to provide maintenance or support. In the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price; to the extent permitted by law, Apple has no other warranty obligation. We — not Apple — are responsible for addressing any claim relating to the App, including product liability, legal compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. General

If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between us about the App. You may not assign these Terms; we may assign them in connection with a merger or sale of assets. We may update these Terms; continued use after the "Last updated" date means you accept the revised version.
